12) A COURT OFFICER'S OATH ...

OF ALLEGIANCE TO HER MAJESTY, QUEEN ELIZABETH THE SECOND, AS REPRESENTED BY THE LIEUTENANT GOVERNOR OF ONTARIO AND THE ATTORNEY GENERAL OF ONTARIO and THE LAW SOCIETY OF UPPER CANADA!


Judicial Oath
        4. The Judicial Oath shall be in the following form:
                      "I, ______________, swear that I will well and truly serve our Sovereign Lady Queen Elizabeth the Second in the office of ______________, and will do right to all manner of people, after the laws and usages of this province, without fear or favour, affection or ill-will; so help me God.".

INDEED!  - "Will do right to all manner of people... without fear or favour, affection or ill-will; 
so help me God."

1) This Jurisdictionally Distant, British Columbia domiciled, Canadian Citizen is asking this Master for nothing MORE, yet nothing LESS, during his tenure as a Court appointed Officer!

2) During the arduous assessments of case history, while considering the rhetoric of proportionality and relevance, human frailty could perchance creep in. Upon considering the issues at hand, with an 'in-the-flesh-present' Defending Party in the Jurisdiction of application incessantly demanding more, a possible subjectivity, with some loss of proportionality, may come to overbear the issues at hand!

When human nature is confronted by demands of 'like and kind,' is it possible that proportionality and relevance could fall by the wayside? Is it feasible that 'relevance' "under the circumstances" may replace the Rules of Civil Procedure as set (in stone)?

So, sadly, interprets this elder Canadian. Being mentally exhausted, he is no longer physically able to comply with what he considers dribble 'water-torture' trivia. With Defense in their continued efforts to prove their "Product Liability," venturing to prevent, AT ALL COST, THIS CASE TO BE ASSIGNED A TRIAL!

With a 'Pro-Forma' Mediation stamped, and the Master's earlier Orders indicating, I ask this Court of Justice to please order this case TO TRIAL and allow the Rules of Civil Procedure to reign!

For now, I rest my Case.

This too will pass...
